1. Notice to customers regarding privacy protection

EXKI S.A., with its registered office located at 1050 Brussels, Chaussée d'Ixelles 12, having enterprise number 0472.429.986, acting as data controller, processes and uses personal data relating to its customers (hereinafter referred to as the "Customers"), in accordance with applicable data protection regulations, in particular European Regulation 2016/679 of 27 April 2016 known as the General Data Protection Regulation (hereinafter referred to as the "GDPR").

This notice regarding privacy protection aims to explain why and how EXKI collects personal data about its Customers (hereinafter referred to as "Customer Data"), how it protects it, and how long it keeps it.

This notice does not prejudice specific provisions that might appear in other documents where applicable.

Respect for Privacy

The personal information you communicate to EXKI, particularly during your registration as a user of the Site, is not transmitted to third parties for marketing purposes without your prior consent.

This information is only used within the framework set by the Regulation on privacy protection.

Furthermore, this information is stored and processed on servers located in Europe, for which EXKI ensures that access is secured in the best possible way, both physically and technologically.

You are asked not to use EXKI's services and the Site if you do not agree with the Regulation on privacy protection.


1.1 Why does EXKI process Customer Data?


EXKI keeps and processes Customer Data, in electronic form or otherwise, for administrative, marketing, and customer management purposes, more particularly in light of the following non-exhaustive activities:

  • process and respond to any communication, request, or query that Customers submit to EXKI (including via the website) or following a first contact from EXKI;
  • process information relating to the online sale (actual or potential) of EXKI's products and/or services and send statements and invoices to Customers;
  • provide Customers with newsletters and other marketing communications;
  • conduct surveys and market research;
  • improve EXKI's products and/or services;
  • resolve disputes.

1.2 What are the legal bases for processing Customer Data?


Customer Data is processed on the basis of one or more of the following legal bases:

• With a view to the conclusion and management of the performance of a sales contract or other contract with a Customer, including the invoicing procedure;

• In order to comply with legal obligations applicable to EXKI (e.g., regarding tax matters, etc.);

• In the context of the legitimate interests of EXKI and/or a third party but which, in EXKI's opinion, also benefit the Customers, such as, but not limited to, direct marketing and data analysis;

• The consent of the Customer concerned (e.g., to respond to a customer satisfaction survey).

The concerned Customer can withdraw their consent at any time, it being understood that such withdrawal will not affect the lawfulness of the processing carried out before this withdrawal on the basis of this consent.


1.3 What are the categories of processed Customer Data?


Customer Data is all personal information concerning an identified or identifiable natural person.

For the aforementioned purposes, the processing of personal data may include the following categories:

• Personal identification data, such as name and address;

• Electronic identification data, such as e-mail address and phone number;

• Personal details, such as date of birth, language, nationality, and gender;

• Consumption habits (purchase volume, sales history, etc.);

• Attendance at events (including family members, if applicable);

• Data resulting from surveys.


1.4 Where does Customer Data come from?


When a Customer contacts EXKI, the initial data usually comes from the Customer themselves or indirectly through their visit to our website (e.g., cookies).

EXKI may also contact a Customer for prospecting purposes when the initial data has not been obtained from them but from other people who have transmitted this data to EXKI.

Within the framework of their relationship with EXKI, the concerned Customer will provide EXKI with additional information (e.g., information necessary for the purchase order).

If the Customer does not provide EXKI with the information required by law or contract, EXKI may decide not to take into account the requests or orders placed by the Customers.

Also, if the Customer does not provide other information, they may not benefit from the related advantages.

For example, if a Customer does not wish to share their e-mail address with EXKI, he/she will not receive any of EXKI's electronic newsletters.

EXKI may also receive data relating to a Customer from other customers, suppliers, or, more generally, from other people with whom the Customer is led to exchange this data within the framework of their relationship with EXKI.


1.5 Who has access to Customer Data?


For the aforementioned purposes, personal data may be disclosed to, and even possibly processed by:

• The Customers themselves;

• EXKI's staff who have a need to know the personal information involved;

• Individuals and legal entities that have direct contacts with EXKI, such as its subsidiary companies or franchisees;

• Public authorities in accordance with applicable regulations, such as the tax administration;

• Service providers (for example for website maintenance, for assistance during promotional campaigns, etc.) and EXKI's other professional advisors who have a need to know this information.


1.6 Is Customer Data transferred outside their country of residence?


In general, this data is kept in Belgium but we may transfer certain information concerning Customers abroad, but always in connection with the management of our activities.

If this involves a transfer of data outside the European Union, EXKi will have implemented appropriate safeguards in accordance with the GDPR.


1.7 How long is Customer Data kept?


Customer Data will not be kept longer than necessary for the aforementioned purposes.

Regarding data transmitted in the context of observations or requests, the transmitted data is kept for 1 month after we have responded to it.

Regarding data transmitted indirectly by our system, the data is only kept for 1 month after the visit to our website.

Regarding data transmitted on the occasion of an online order via our website, your data is kept for 12 months.

Otherwise, Customer Data will be kept as long as EXKI may have legal liability for which the use of Customer Data may be relevant, taking into account applicable limitation periods and legal retention obligations.


1.8 How is Customer Data protected?


EXKI deploys its best efforts to keep and protect Customer Data against loss, disclosure, or unauthorized access.


1.9 What are the rights of individuals and who can they contact?


Individuals whose personal information is collected and processed as Customer Data have, at any time and provided they provide sufficient proof of their identity, the right to contact EXKI if they wish to:

• Access, rectify, or erase their personal data ;

• Restrict or oppose the processing of their personal data (e.g., for direct marketing purposes) ;

• Receive the data they have provided in a structured, commonly used, and machine-readable format and transmit it to another data controller if they wish, when it has been processed on the basis of their consent and/or the execution of the contract ;

• Receive additional information on the safeguards in case of international data transfers ;

• File a complaint with the Belgian Data Protection Authority or another EU supervisory authority, if they believe that EXKI has not acted in accordance with the applicable data protection regulations.

1.10 Changes


EXKI is likely to modify this notice regarding privacy protection at any time when necessary, in particular to comply with changes in regulations or requirements introduced by data protection authorities.

2.2 Applicable law and competent jurisdictions


This Site, its operation, and its use are governed by Belgian law alone, to the exclusion of rules relating to conflicts of laws.

Unless otherwise provided by mandatory law, the French-speaking courts of Brussels are solely competent for any dispute related to access and/or use of this Site.
